So, what made you import yourself here? You could have stayed back in your own country..by the way, coming on a H4 was a choice..it wasn't forced upon you...didn't you know before coming here that you would have to stay home on a H4? H4->F1, H4->H1...all these options are always open to you..

I believe if you get your Credit score reports from Experian and others, it lists all the addresses you ever lived in USA. You can get free Credit score reports from agency once a year.
use www.zabasearch.com, its s free search and usually shows all your address pretty good if your telephone number was listed in the directory

There is nothing called h1b jobs. There is no job reserved for someone on h1b. So to say that people on l1 are taking h1b jobs is kind of funny.
At the same time, that anti-immigrant l1fraud is here to scare people and is against the community. But because most people here are not on L1, so most people are agreeing with l1fraud user. As if L1 folks are getting ahead of us, and L1 folks are taking our jobs, same mentality and outlook as that of the disgruntled programmers at programmers guild. Maybe there is nothing wrong about that because, humans as species have always behaved as part of the food chain, eating and living on the ones below us. Likewise, people here just want to blame someone else for their problems, including delay in GCs, on others on L1. So the entire focus of this thread is "l1fraud". From time to time, some anti-immigrant or someone from another site come in and divide people here without much of an effort, that we are just a bunch of losers, yes that's right, people who play into the hands of anti-immigrants and people who play into the designs of the agents of other agenda's are nothing but losers. Based on the criteria above I dont see how it is illegal to ask what type of work authorization one has, and if EAD , how long it is valid. It may be illegal to disqualify a candidate who has EAD with validity for the required amount of time. But I sure can ask about the details within legal limits, can't I?

It is illegal... On I-9 it clearly says that an employer can not deny employment because of an expiry date on a valid work authorization document. I guess we'll need to ADD to that number:
1. BEC stuck folks who could not file in July 07
2. PERM approvals starting August 07
to the 47,728. Plus multiply by 2.1( for dependents ). That'll give the total VISA numbers required for this category to make it Current.
If I have to guess-- (1) would be very less, may be 100-200 max
(2) around 5000 ( just a PUMA)
So, there are about 53000 EB2 I applications. and 2.1 * 53000 = 111300.
If we can create 111300, EB2 I visas then it'll be CURRENT. easy:)

One of my friend got approved yesterday.
He interfiled from EB3 to EB2.
His EB3 PD - 12/2003
He got the EB2 approved sometime in Jan 2009.
His RD - 05/2009 (Yes it is right, he applied his 485 in May 2009).

There is nothing wrong in reporting fraud.
However your argument that you are reporting it since you cannot tolerate fraud isn't that convincing.
If you were always against injustice/lawlessness, you will see a lot of it in your daily life. Do you report or take action against each of those ? I don't think so.
After living in India for long and seeing people put up with all injustice and sometimes doing it themselves, it is hard to believe your argument that you are doing it just for the sake of law.
I am not saying that we are reporting fraud just for the sake of not tolerating it. This is effecting our GC. Earlier the effect was related to the job being taken away now it is effecting our GC too.
Initially L1s were sponsored only by large offshore companies like TCS, WIPRO etc.. The effect was that the jobs were taken away. But it did not have much effect on the GC side as most of these large offshore companies do not process GC for their employees.
But nowadays lots of small Offshore companies started doing L1As. These companies do not have lots of clients like TCS or WIPRo but they have a handfull of clients. So to make sure they have their clients they started bringing people in L1As and processing GC under EB1 for them. Although many of these people are developers and should be in EB3 and should be behind in the line. But as they are in L1A and are appling in Eb1 they are getting GC in no time and also taking the visa#s away. There are hunderes of these small offshore companies started getting people in L1As. Thus these EB1 Visa #s are not overflowing to EB2. This is effecting our GC.
Now we have :
1. Large offshore companies sponsored L1s taking the jobs
2. The small offshore companies sponsored L1s taking the GC visa #s.
If the L1As are indeed senior Manager then no problem, but the Developers/Business Analyst/ Project Manager without hire-fire authority are getting GC under EB1.
Thus these frauds should be reported so that at least the # of EB1 visas are not taken by fraud.
So you too can see how this fraud is effecting us all.

I am a silent visitor of this website.
Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??
Please try to understand their problem.
Also India is the great. Why don't you guys just think that India is your home country where you are born and brought up. Why you people can't just wait and watch?? If nothing happens to the so called GC, then why don't you think to pack up and go back to India???????

Hi All,
Its been astonishing journey, came to US in 2000 June, saw downfall of .coms followed by Housing bubble burst, than 911 , than Economical challenges, Job losses, etc.... the irony list are/were endless. Hope of GC was next to impossible.
Following were the steps to miracle :
- Filed Labor in 2005 Dec, got denied due to lawyers mistake:mad:
- Refiled the same application and Got approved in March 2006:D
- Applied I-140, paid extra for premium but it took more than 4 months to approve.:mad:
- Fight with employer, left company overnite, guess when ?(2 weeks before July Fiasco :mad:)
- Refilled labor in Jan 2008, Got approved in March 2008
- RFE on previously approved I-140
- Convinced lawyers to file application for I-140 , requesting PD recapturing.
- Got I-140 Approval in Aug 2008
- Filed I-485 in Aug 2008
- FP in Oct 2008
- RFE in Aug 2009
- Contacted Congressman, it was helpful as got to know the exact situation.
- Took infopass 2 times
- Not sure if this helped or not but called 1-800 number and spoke with level 2 officer and she hinted that I may not have to wait that long ?
- Approval in Sep 2010

If the job required a EB2 or EB3 but EB3 was filed earlier. Is that possible?

Lufthansa is another option for no transit visa, cheaper ticket than NW, Emirates or Singapore airlnies, little bit security check at Frankfurt when returning .....
with emirates, there is a route via dubai (no torture) and one via hamburg + Dubai. I traveled via the second one twice on emergencies. you are ushered in a square box of a building with barbed wires and armed (fully armed and body armored, hand gunned, you-mongrel-looking) guards. There is even a special
barbed wire line for 'special immigrant' (read asylum or illegal migrants) inside though i have not seen it used. then comes double wammy security checks (show-me-your-baby'smilk-is-edible type). There is one bathroom for each gender that has useless (over 10 months)faucets and one bar (no shop for food). the layover reminded me of concentration camps. But it was still better than $274 ;-)

I had an appointment on Jan 10th, 1 pm got the stamped passport same evening at 6 pm from the VFS office
